1. About iSOKO
iSOKO is a digital marketplace operated by [LEGAL ENTITY NAME] ("iSOKO", "we",
"us") that connects buyers, sellers (traders), and trade associations in Kenya.
These Terms & Conditions ("Terms") govern your access to and use of the iSOKO
mobile application and related services (the "Platform"). By creating an account
or using the Platform, you agree to these Terms.
2. Eligibility and accounts
You must be at least 18 years old to use iSOKO. You are responsible for the
information you provide, for keeping your login details secure, and for all
activity under your account. You agree to provide accurate information and to
keep it up to date.
3. The role of iSOKO
iSOKO is a platform that lets sellers list goods and services and lets buyers
discover and contact them. Any contract for the sale of goods or services is
made directly between the buyer and the seller. iSOKO is not a party to that
contract, does not take ownership of any items, and does not process payments
between buyers and sellers. Payment, delivery, refunds, and after-sales matters
are agreed and carried out directly between the buyer and the seller.
4. Listings and seller obligations
Sellers are responsible for the accuracy of their listings — descriptions,
prices, availability, and images — and for ensuring that the goods and services
they offer are lawful and that they hold any licences the law requires.
Prohibited, counterfeit, unsafe, or illegal items must not be listed.
5. Buyer responsibilities
Buyers should review listings carefully and communicate with sellers before
committing to a purchase. Because transactions take place directly between
buyers and sellers, buyers should take normal care when arranging payment and
delivery.
6. Acceptable use
You agree not to misuse the Platform, including by posting false, misleading,
offensive, or unlawful content; harassing other users; attempting to defraud;
scraping or interfering with the Platform; or impersonating others. We may
moderate, suspend, or remove content and accounts that breach these Terms.
7. Ratings, reviews, and messaging
The Platform includes messaging and ratings features. You are responsible for
what you post. Reviews must reflect genuine experiences. We may remove content
that is abusive, fraudulent, or unlawful.
8. Associations
Trade associations may register on iSOKO and offer membership to sellers.
Associations and their members are also subject to the Association Terms &
Conditions.
9. Intellectual property
iSOKO, its logos, design, and software are owned by [LEGAL ENTITY NAME]. You
keep the rights to the content you submit but grant iSOKO a non-exclusive
licence to host and display it for the purpose of operating the Platform.
10. Disclaimers and liability
The Platform is provided "as is". Because iSOKO is not a party to transactions
between users, we are not responsible for the quality, safety, legality, or
delivery of goods and services offered by sellers, nor for the conduct of any
user. To the extent permitted by law, iSOKO's liability arising from your use of
the Platform is limited, and we are not liable for disputes between buyers and
sellers.
11. Suspension and termination
We may suspend or terminate access for breach of these Terms or where required
by law. You may stop using the Platform and delete your account at any time.
12. Changes to these Terms
We may update these Terms from time to time. When we publish a new version, it
replaces the previous one, and continued use of the Platform means you accept
the updated Terms.
13. Governing law
These Terms are governed by the laws of the Republic of Kenya, and disputes are
subject to the jurisdiction of the Kenyan courts.
